1. Agreement to Terms
By enrolling in the Aberio Report Certification Training, you agree to these Terms of Service. This training is designed for disability advocates, government accessibility professionals, and civil rights workers who want to use the Aberio testing tool to identify and document accessibility barriers.
2. Training Access & Enrollment
2.1 What You Get
- Annual membership: $49/year (USD)
- Lifetime access: Once enrolled, access never expires
- 6 comprehensive modules covering WCAG 3.0, ADA Subpart H, behavioral noise analysis, and advocacy strategies
- Certificate of completion after passing the final exam (75% required)
- Retake exam unlimited times at no additional cost
2.2 Access Delivery
After payment is confirmed, you will receive a unique access code via email within 24 hours. This code grants you permanent access to the training course. Access is browser-based and does not require installation of any software.
2.3 Account & Progress
Your progress is saved locally in your browser using localStorage technology. This means:
- Your progress is private and stored only on your device
- We do not track your learning activity
- Clearing browser data will reset your progress (save your access code to re-enroll)
- You can access the course from multiple devices using your access code
3. Payment & Refund Policy
3.1 Payment Processing
Payments are processed securely through PayPal. We do not store credit card information on our servers.
3.2 Refund Policy
7-Day Money-Back Guarantee: If you complete Module 1 and decide the training isn't right for you within 7 days of enrollment, email us at AberioReport@gmail.com and we'll issue a full refund, no questions asked.
After 7 days: No refunds are provided once you've accessed Module 2 or beyond, as you have received access to the full course materials.
3.3 Revenue Use
Revenue from this training supports mental health advocacy and accessibility work through our LLC. This is not a profit-maximizing venture - pricing is set to sustain advocacy efforts and expand access to mental health care resources.
4. Permitted & Prohibited Uses
4.1 Permitted Uses
You may use this training and the Aberio testing tool to:
- Document accessibility barriers for ADA advocacy work
- Support complaints under ADA Subpart H (effective communication)
- Educate colleagues about accessibility testing
- Generate reports for internal organizational use
- Identify areas where developers should remove barriers
4.2 Prohibited Uses
You may NOT:
- Sell or resell the training content without written permission
- Share your access code with others (each person needs their own enrollment)
- Use Aberio reports as compliance certification - Aberio detects friction, not full WCAG compliance
- Misrepresent Aberio's capabilities to clients or organizations
- Use the tool for automated scanning at scale (designed for targeted critical path testing)
- Bypass or circumvent course access controls
5. Intellectual Property
5.1 Ownership
All course content, the Aberio testing tool, behavioral noise analysis methodology, and related materials are owned by Aberio Report and protected by intellectual property laws. The behavioral noise detection system is patent pending.
5.2 License Grant
Upon enrollment, you receive a non-exclusive, non-transferable license to:
- Access and complete the training course
- Use the Aberio bookmarklet for testing purposes
- Generate and use Aberio reports for advocacy work
- Reference your certification in professional contexts
6. Disclaimers & Limitations
6.1 Educational Purpose
This training is for educational purposes and teaches advocacy skills. Completion does NOT make you a certified accessibility auditor, WCAG expert, or legal consultant. It teaches you how to use Aberio effectively for disability rights advocacy.
6.2 Tool Limitations
Critical Disclaimer: The Aberio tool is a triage instrument that detects behavioral friction. It is NOT:
- A comprehensive WCAG 2.1 compliance checker
- A replacement for testing with real disabled users
- A certification of accessibility
- Legal advice or legal representation
Aberio helps you identify where to focus advocacy efforts - it does not replace human judgment, assistive technology testing, or legal counsel.
6.3 No Warranties
The training and tool are provided "AS IS" without warranties of any kind. We make no guarantees that:
- The tool will detect all accessibility barriers
- Aberio reports will guarantee legal outcomes
- Course content will meet all your organizational needs
- Access will be uninterrupted or error-free
6.4 Limitation of Liability
Aberio Report's liability is limited to the amount you paid ($49). We are not liable for indirect, incidental, or consequential damages arising from use of the training or tool.
7. Privacy & Data
7.1 What We Collect
When you enroll, we collect:
- Your email address (for access code delivery and support)
- Payment information (processed by PayPal, not stored by us)
7.2 What We Don't Collect
- Learning progress (stored locally in your browser)
- Test results or exam scores
- Websites you test with Aberio
- Any data about your testing activity

8. Updates & Changes
8.1 Course Content Updates
We may update course content to reflect:
- Changes in WCAG standards
- Updates to ADA regulations
- Improvements to the Aberio tool
- New advocacy strategies
You'll receive free access to all updates - no additional payment required.
8.2 Terms Updates
We may revise these Terms of Service. If changes materially affect your rights, we'll notify you via email. Continued use after notification means you accept the updated terms.
9. Termination
9.1 Your Rights
You may stop using the course at any time. Your access remains available even if you don't use it.
9.2 Our Rights
We may terminate access if you:
- Violate these Terms of Service
- Share access codes with others
- Use the tool in prohibited ways
- Engage in fraudulent activity
In case of termination for cause, no refund will be issued.

11.2 Governing Law
These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Colorado, and you consent to personal jurisdiction and venue there.
11.3 Dispute Resolution
Before taking legal action, please contact us at AberioReport@gmail.com to resolve disputes informally. Most issues can be worked out through conversation.
11.4 Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

12.1 Individual vs. Enterprise Use
This $49/year training is for individual use. If you represent an organization that wants to:
- Enroll multiple employees
- Distribute the tool organization-wide
- Customize training for your agency
- License Aberio Enterprise for comprehensive testing
